Terms of Use

IMPORTANT – READ CAREFULLY: Lea is not a medical device, health service, or clinical therapy. Lea does not diagnose, treat, or prevent any disease or mental health condition, and must not be used for crisis intervention, emergencies, or life-threatening situations. If you are in danger or considering self-harm, call local emergency services immediately or contact a crisis hotline available in your country.
Introduction
These Terms of Use (“Terms”) are a legally binding agreement between you and Lea AI LLC (“Lea,” “we,” “our,” or “us”) governing your access to and use of Lea’s products and services, including the mobile apps (iOS and Android) and websites (including leahelps.com) (collectively, the “Service”). By accessing or using the Service, you agree to these Terms and our Privacy Policy at https://leahelps.com/privacy-policy. If you do not agree, do not use the Service.
The canonical version of these Terms is hosted at https://leahelps.com/terms. If there is any conflict between these Terms and platform-specific terms (e.g., Apple App Store, Google Play), the canonical version controls as between you and Lea, and the platform’s terms control as between you and that platform.
1) Purpose and non-medical use
1. Wellness only. Lea provides general mental wellness and self-care support (e.g., journaling prompts, reflective questions, coping ideas, education, and encouragement).
2. No professional advice. Lea is not a substitute for professional advice, diagnosis, or treatment from a licensed physician, psychologist, psychotherapist, counselor, or other qualified provider.
3. No emergencies. Lea is not designed for emergencies or acute risk. If you believe you may harm yourself or others, call emergency services now or use a crisis hotline.
4. No therapeutic relationship. Your use of Lea does not create a doctor-patient, therapist-client, or any other professional relationship.
5. No guarantees. Information may be incomplete, inaccurate, out-of-date, or not applicable to your situation.
2) Age and eligibility
You must be 18 years or older to use the Service. By using the Service, you represent and warrant that you are at least 18 and have the legal capacity to enter into these Terms.
3) AI disclosures and limitations
1. AI-generated content. Lea uses artificial intelligence models (including from third-party providers such as OpenAI and Google) that generate responses based on patterns and your inputs. AI outputs can be incorrect, misleading, or inappropriate.
2. Human review. Unless we explicitly say otherwise, messages are not reviewed by clinicians and are not monitored 24/7.
3. Personal discretion. You are solely responsible for how you interpret and use the information. Always seek the advice of a qualified professional for questions about your mental or physical health.
4) HIPAA; sensitive information
1. Not HIPAA-compliant. Lea is not intended to store or transmit Protected Health Information (PHI) and is not HIPAA-compliant.
2. Do not share PHI. Do not submit medical records, diagnoses, prescriptions, precise geolocation of healthcare visits, or other PHI through the Service.
5) Accounts, conduct, and acceptable use
1. Your responsibility. You are responsible for your account and for all activity under it. Keep your credentials secure.
2. Prohibited behavior. You agree not to:
• Use the Service for unlawful, harmful, deceptive, or fraudulent purposes;
• Upload or generate content that is illegal, hateful, harassing, sexually explicit, exploitative, or that violates others’ rights;
• Attempt to reverse engineer, scrape, or otherwise misuse the Service or the AI models;
• Multi-account to bypass usage limits, fair-use, or subscription rules;
• Interfere with or disrupt the Service (e.g., DDoS, automated scraping, or unauthorized APIs).
3. Fair use. We may set or adjust rate limits, daily allowances, or “credit” thresholds to ensure reliability and equitable access.
6) Platforms and third-party services
1. Multiple channels. Lea may be accessed via iOS (Apple App Store), Android (Google Play), and the web. Each platform has its own terms and privacy policy which also apply (e.g., Apple Media Services Terms, Google Play Terms).
2. Third-party AI providers. We use third-party AI APIs. Your inputs and outputs may be processed by those providers to deliver the Service, subject to their security controls and data policies.
3. Links. The Service may link to third-party resources. We do not endorse or control them and are not responsible for their content or practices.
7) Privacy
Our Privacy Policy (https://leahelps.com/privacy-policy) explains what we collect and why. By using the Service, you consent to our data practices described there. Do not share personally identifiable information you are not comfortable disclosing. Avoid sharing PHI (see Section 4).
8) Subscriptions, in-app purchases, credits, and refunds
1. Subscription options. We may offer free tiers (with daily credits) and paid subscriptions (weekly, monthly, quarterly, or other periods). “Credits” represent a usage allowance (e.g., number of messages).
2. Apple App Store (iOS). If you purchase via Apple, billing and auto-renewal are managed by Apple. Manage or cancel in Settings » Apple ID » Subscriptions. Apple’s refund policies apply.
3. Google Play (Android). If you purchase via Google Play, billing and auto-renewal are managed by Google. Manage or cancel in Play Store » Payments & subscriptions. Google’s refund policies apply.
4. Website purchases. If you purchase via our website, subscriptions auto-renew for the period you chose unless canceled before the renewal date. Payment processing is handled by our third-party processor.
5. Our refund window for website purchases (where we are merchant of record): You may request a refund within 24 hours of purchase and only if you have sent no more than 30 messages during that period. Platform-specific policies (Apple/Google) may override this section for purchases made through those platforms. To request a refund where we are the merchant of record: support@leahelps.com.
6. Changes. We may change prices, plans, or credit allocations prospectively. We’ll notify you of material changes as required by law or platform policy.
7. Non-transferable. Credits and subscriptions are not transferable and have no cash value.
9) Research and improvement
With your consent where required, we may use anonymized or aggregated data to improve the Service and for internal research. We will not attempt to re-identify anonymized data.
10) Intellectual property
1. Our rights. The Service, including software, models, text, designs, and trademarks, is owned by Lea AI LLC or its licensors and is protected by IP laws.
2. Your content. You retain ownership of content you submit. You grant Lea a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and analyze your content solely to provide and improve the Service and as otherwise described in our Privacy Policy.
3. Feedback. If you provide ideas or feedback, you grant us a perpetual, irrevocable license to use them without obligation.
11) Disclaimers
1. AS IS / AS AVAILABLE. The Service is provided “AS IS” and “AS AVAILABLE.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
2. No medical advice. Lea does not provide medical, psychological, legal, or other professional advice. Always consult a qualified professional.
3. No guarantee of results. We do not guarantee any outcomes, improvements, or availability of the Service at all times.
12) Limitation of liability
To the maximum extent permitted by law: Lea AI LLC, its affiliates, officers, employees, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or business. Our total liability for any claims will not exceed the amounts you paid to Lea (if any) in the 12 months preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
13) Indemnification
You agree to defend, indemnify, and hold harmless Lea AI LLC and its affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your content; (b) your misuse of the Service; (c) your violation of these Terms or applicable law; or (d) your infringement or misappropriation of any third-party rights.
14) Suspension and termination
We may suspend or terminate your access at any time, with or without notice, if we believe you violated these Terms or pose risk to others, the Service, or our vendors. Users who breach the rules may not be eligible for refunds. You may stop using the Service at any time. Sections that by their nature should survive termination will survive (including payment obligations, IP, disclaimers, limitations, and dispute resolution).
15) Changes to the Service and to these Terms
We may modify or discontinue features at any time. We may update these Terms from time to time. If changes are material, we will provide notice as required by law or platform policy and indicate the “Last updated” date above. Your continued use after changes become effective constitutes acceptance.
16) Export controls; compliance
You agree to comply with all applicable export, sanctions, and trade laws and not to use or provide the Service where prohibited.
17) Governing law; venue; dispute resolution
Governing law. These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules.
Venue. Except as otherwise provided below, the exclusive venue for disputes is state or federal courts located in Delaware, USA, and you consent to personal jurisdiction there.
Informal resolution. Before filing a claim, you agree to first attempt to resolve the dispute by emailing support@leahelps.com with “Dispute” in the subject line and a description of your claim; we’ll try to resolve it within 30 days.
Arbitration (optional clause; remove if you prefer court only). Except for claims that can be brought in small-claims court or for injunctive relief, any dispute shall be resolved by binding arbitration administered by JAMS in English, on an individual basis (no class actions). You may opt out of arbitration within 30 days of first acceptance by emailing support@leahelps.com with “Arbitration Opt-Out.”
Class action waiver. You and Lea agree that each may bring claims only in your or its individual capacity, not as a class member or representative.
18) Consumer rights and platform rules
Nothing in these Terms is intended to limit any non-waivable consumer rights under applicable law. Where you purchased via the App Store or Google Play, the platform’s rules on cancellation, renewals, and refunds apply and may supersede some provisions here as to those transactions.
19) Crisis resources (non-exhaustive; examples)
Lea does not provide crisis services. If you are in immediate danger, call your local emergency number. Examples of crisis resources include national or local hotlines available in your country/region. Availability varies; check official sources for up-to-date contacts.
20) App-store specific notices
Apple App Store: This EULA is between you and Lea AI LLC, not Apple. Apple is not responsible for the Service or its content and has no obligation to provide maintenance or support. To the extent required by Apple’s policies, Apple and its subsidiaries are third-party beneficiaries of these Terms.
Google Play: Your purchase and use are also governed by Google Play Terms of Service.
